Terms of Use
1. The service
RSA Tool is browser-based software that helps road safety auditors capture observations from video or at site with GPS-linked chainage and generate audit reports. The field tool runs in your browser; audit content you create is stored on your own device, not on our servers.
2. Licence
- Subject to these terms and payment of the fees, we grant you a non-exclusive, non-transferable, non-sublicensable licence to use the service for your internal professional work during the licence period shown in your account.
- Every plan gives unlimited use of the tool for its period. The licence ends at 23:59 India time on the expiry date unless it is renewed.
- A licence is for the named account. It may be used on up to the number of devices set for it; signing in on another device beyond that limit signs out the oldest one.
- Free trials and demo licences are for evaluation only, for the period we set, and may be ended at any time.
- An active internet connection is needed to sign in and to check the licence when the tool starts and periodically while it is open.
3. Accounts
Accounts are created by us on request. Keep your password confidential and do not share your account. You are responsible for activity under your account. Tell us promptly if you suspect unauthorised use.
4. Fees and payment
- Fees are as shown on our website or agreed with you in writing (for custom plans), in Indian rupees and exclusive of GST and other applicable taxes, which are added to invoices.
- Fees are payable in advance for the licence period, by the methods we accept. Access may be paused or suspended if payment is overdue.
- Unless agreed in writing, fees are non-refundable, including for unused parts of a licence period.
- We may change our prices for new licences and renewals; a licence already paid for keeps its agreed price.
5. Acceptable use
You must not:
- share your account, resell or provide the service to third parties, or use it beyond your licence;
- attempt to bypass or interfere with sign-in, licence checks, the device limit or other security measures;
- copy, modify, reverse-engineer or create derivative works of the software except as allowed by law;
- use automated means to access the service, overload it, or probe it for vulnerabilities without our written permission;
- use the service for anything unlawful or to infringe anyone's rights.
6. Engineering responsibility
The observations, risk ratings, priorities, recommendations, summaries and chainages produced or suggested by the tool are indicative aids only. They are not a substitute for professional judgement. Every report must be reviewed, verified and approved by a qualified road safety engineer before it is issued or relied on.
Chainage is derived from your route file, GPS data and calibration, and can be affected by GPS accuracy and data quality; verify it on site for important locations. Recommendations refer to published guidance (such as IRC and MoRTH documents); check that the current versions apply to your project. You remain solely responsible for your audits, reports and any decisions based on them.
7. Your data
- You own the audit content you create. Because it is stored only on your devices, you are responsible for backing it up (for example with the ZIP export). We cannot recover it if a device or browser data is lost or cleared.
- Our handling of personal data is described in the Privacy Policy, including the usage metadata we record.
8. Intellectual property
The software, its design and content (including the issue library and report templates) belong to us or our licensors. Reports you generate are yours to use.
9. Availability and changes
We aim to keep the service available but do not guarantee uninterrupted access; maintenance, updates or events outside our control may cause interruptions. We may improve or change features; we will not materially reduce the core functionality of a paid licence during its period.
10. Suspension and termination
We may suspend or end access immediately if you breach these terms, misuse the service or do not pay. You may stop using the service at any time. On expiry or termination the licence ends; data on your devices remains yours.
11. Warranties and liability
- The service is provided “as is” and “as available”. To the extent permitted by law we exclude all implied warranties, including fitness for a particular purpose.
- We are not liable for indirect, incidental, special or consequential loss, loss of profit, revenue, data or goodwill, or for losses arising from reliance on a report that was not reviewed as required in section 6.
- Our total liability arising out of or relating to the service is limited to the fees you paid for the licence in the 12 months before the event giving rise to the claim.
- Nothing in these terms limits liability that cannot be limited under applicable law.
12. Indemnity
You will indemnify us against third-party claims arising from your breach of these terms or from reports you issue without the review required in section 6.
13. Governing law and disputes
These terms are governed by the laws of India. The courts at Vadodara, Gujarat have exclusive jurisdiction, subject to any mandatory law. We will first try to resolve any dispute amicably through discussion.
14. Changes to these terms
We may update these terms; the date at the top shows the current version. Continued use after an update means you accept it.
